Partner Visa Categories: A Guide to Choosing the Right Path

There are three main subclasses for partner visas, but they can be broadly divided into two categories: the Prospective Marriage visa and the Partner visa. The type of visa you should apply for depends on your relationship status.

Here are the types of relationships and the corresponding visas:

If your visa has been refused or cancelled under section 48 of the Migration Act 1958, you generally cannot apply for most visas while in Australia. However, since 14 September 2009, you may still be eligible to apply for a Partner visa if you meet specific criteria:

You haven’t had a partner visa refused since your last entry into Australia.
You haven’t had a visa refused or cancelled on character grounds under section 501.
You provide a completed and signed form 40SP Sponsorship for a partner to migrate to Australia from an Australian citizen, permanent resident, or eligible New Zealand citizen who is your spouse or de facto partner.
You submit two statutory declarations from Australian citizens, permanent residents, or eligible New Zealand citizens (other than your partner) supporting your relationship, made within six weeks before your Partner visa application.

The Partner Visa (Subclass 309/100 - Offshore) and Partner Visa (Subclass 820/801 - Onshore) allow individuals who are the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen to live in Australia.
The offshore visa (309/100) is for those applying from outside
The onshore visa (820/801) is for applicants already in the country.

The Prospective Marriage Visa (Subclass 300) is for those engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen, allowing them to enter Australia to get married.
